This Criminal Petition under Section 438 Cr.P.C. is filed by the petitioners - Accused Nos. 12 and 13 seeking bail in the event of their arrest in connection with Crime No. 143 of 2018 on the file of Madgulapally Police Station, registered for the offences punishable under Sections 120(b), 409, 406, 420, 463, 471 read with Section 149 IPC.

The case of the prosecution is that on 29.09.2016, at about 12.00 hours, the complainant Gogulothu Rajendar, District Manager (FAC), TSCSCL, Nalgonda had lodged a complaint stating that AP State Civil Supplies Corporation is procuring paddy in Telangana State from the farmers under Minimum Support Price through agencies and the same quantity is supplied to designated rice mills for undertaking custom milling. On careful examination of truck chits, there is uncertainty found on the vehicle numbers. Immediately a requisition was sent to MVI, Miryalauda with a request to furnish the ownership and vehicle particulars as they are all false and fabricated.

Learned counsel for the petitioners Sri Rapolu Bhaskar submits that the petitioners are unconnected with the alleged offences and they have been falsely implicated in this case. It is stated that all the allegations are against the other

accused and there are no allegations against the petitioners, hence, their case may be considered for grant of pre-arrest bail. 4.

On the other hand, learned Assistant Public Prosecutor submits that Accused Nos. 1 and 2 in connivance with the petitioners herein misappropriated the amounts and as per the confession of Accused No.1, petitioner No.1 had drawn Rs.19,00,000/- and petitioner No.2 had drawn Rs.2,95,000/-. He further submits that as investigation is pending and as the petitioners have cheated the innocent farmers, they are not entitled for grant of pre-arrest bail.

Taking into consideration the allegations in the complaint, this Court is not inclined to grant pre-arrest bail to the petitioners.
