HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22590 OF 2017 ORDER:

This writ petition is filed by the petitioner seeking a direction to the respondents not to interfere with his possession over the premises bearing No.1-8-893/4, admeasuring 32 sq. yards consisting of 100 SFT Built up area, ACC roof, situated at Sriram Nagar, Bagh Lingampally, Hyderabad. 2.

Heard and perused the material available on record. 3.

The case of the petitioner is as follows:

The petitioner purchased the subject property and at the time of his purchase, one ACC roof room was in existence. The petitioner demolished the said room and constructed permanent structure in its place. Alleging that the petitioner made unauthorized constructions, the respondents came to the subject property and seized the equipment used for construction. The respondents are also trying to demolish the existing structures in the above said property, without following the due process of law. Further, it is the case of the petitioner that no prior sanction of building application is necessary for individual residential building upto 100 sq. meters and that the subject property is a small plot situated in a slum area. When the petitioner tried to make a representation to the 3rd respondent, he refused to acknowledge it. Hence, the petitioner filed this writ petition. 4.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, this Court is inclined to pass the following order:

"The respondents are directed to follow the due process of law, if they intend to interfere with any structures in the subject property belonging to the petitioner."
