The petition coming on for hearing, upon perusing the Petition and the grounds filed in support thereof and upon hearing the arguments of Sri RAI\/ESH CHILLA, Advocate for the Petitioner, PUBLIC PROSECUTOR, for the Respondent No,1, the Court made the following;
ORDER
This Criminal Petition is filed by the petitioner/accused No.4 seeking to quash the proceedings in P.R.C.No.28 of 2020 on the file of the Court of
learned Principal Junior Civil Judge, Miryalaguda, registered for the offence under Section 306 of Indian Penal Code.
Learned counsel for respondent No.Zlde-tacto complainant reported that the matter was subsequently numbered as S.C.No.38 of 2021 and pending on the file of the Court of learned I Additional Sessions Judge, Miryalaguda. Learned counsel further submitted that the trial was at the fag end and the evidence of all the witnesses was recorded except the evidence of the Investigating Officer, who filed the charge-sheet. Learned Assistant Public Prosecutor reported that the matter before the trial Court was posted to 15.03.2024 for the evidence of Investigating Officer. Hence, the learned Assistant Public Prosecutor is directed to inform the Investigating Officer concerned, to appear before the trial Court on that day without fail, so that his evidence could be completed and the matter can be decided.
The learned I Additional Sessions Judge, Miryalaguda, is directed to take up S.C.No.38 of 2021 in a fast track manner and dispose of the said case within a period of (20) days from the date of receipt of a copy of this order.
