Crl.P.M.P.No.18856 of 2016 is filed seeking leave of this Court to compound the offences, in view of the settlement of dispute due to intervention of elders.

2. The offences alleged to have committed by the petitioners are under Sections 498-A, 506 r/w 34 IPC and Sections 3 and 4 of Dowry Prohibition Act.

Both the parties are present-in-person and they are identified by their respective counsel and the parties are also produced photostat copies of Aadhar Cards in proof of their identity. When they were enquired about the compromise, they stated that the petitioners agreed to pay Rs.9,50,000/- towards permanent alimony and accordingly, the petitioners paid the same in the form of DD bearing No.996638, dt. 31.03.2015 drawn on SBH Purapool, Hyderabad. The de facto complainant acknowledged receipt of the same. Even if the trial is continued, the chances of supporting the prosecution case by witnesses are bleak and such trial would end in futility.

Having considered the facts and circumstances of the case and in view of the joint memo filed by both parties and in view of

MSM,J the judgment of the Apex Court in Gian Singh v. State of Punjab and another1 it is a fit case to grant permission to compound the offences as it would not have any impact on the society. 5.

Accordingly, Crl.P.M.P.No.18856 of 2016 is allowed.

6. In view of the orders passed in Crl.P.M.P.No.18856 of 2016, the proceedings in Charge sheet No.252 of 2015 on the file of XIII Metropolitan Magistrate, Nampaly at Hyderabad, are quashed. Accordingly, Crl.P.No.16700 of 2016 is allowed. Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
