THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10570 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Honourable Court may be pleased to issue a Writ order or direction more particularly one in the nature of Writ order or direction more particularly one in the nature of Writ of Mandamus declaring the action on the part of the 2nd respondent in issuing notice to the petitioner in No.193/MK-4/Cyb/2016 dated 29-03-2016 directing the petitioner to obtain order from the Honourable High Court to claim the body of his mother after exhumation and postmortem as illegal, arbitrary and in violation of Principles of Natural Justice and consequently direct the 2nd respondent to handover the dead body of the mother of the petitioner after exhumation and postmortem examination to enable the petitioner to perform funeral rights at his native place as per the desire of his mother late Indira Mohini Krupakar and pass such other order or orders as this Honourable Court may deem fit and proper in the interest of justice."
Learned Assistant Government Pleader for Home informed this Court that the husband of the deceased, the father of the petitioner herein, was insistent upon the body of Late Indira Mohini Krupakar being buried at Hyderabad only.
In the light of this averment, Sri Ganduri Nageswara Rao, learned counsel for the petitioner, would concede that the wishes of the petitioner's father would require to be honoured. The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
