THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.22751 OF 2008 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:- "to issue a writ or order/s more particularly one in the nature of Writ of Mandamus declaring the action of the respondents No.2 & 3 in seeking to dispossess the petitioners from their land in Sy.No.2 of Regadimamidpally Village, Pudur Mandal, R.R.District for the purpose of widening of the existing road leading from Chengamla Village to Vikarabad via Regadimamidipally Village is illegal, arbitrary and violative of Article 300-A of Indian Constitution."

On 20.10.2008, this Court passed an interim order in W.P.M.P.No.29614 of 2008 directing the respondents not to widen the road in question towards the plots of the petitioners, except by initiating the proceedings under the Land Acquisition Act, or with their consent.

Considering all the facts and circumstances of the case and as the matter pertains to the year 2008, this Court is of the view that the grievance of the petitioners can be redressed by making the aforesaid interim order as a final order. 4.

Accordingly, the interim order, dated 20.10.2008, passed in W.P.M.P.No.29614 of 2008 is made absolute and the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
