THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.9004 OF 2013 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in Crime No.203 of 2010 on the file of Yemmiganur Police Station, Kurnool District, registered for the offences punishable under Sections 341, 506 read with 34 of Indian Penal Code (for short "I.P.C.") and Section 16 of A.P.Micro Finance Institutions (Regulation of Money Lending) Ordinance Act, 2011. The main contention of the learned counsel for the petitioner is that the Act itself is challenged in the batch of writ petition Nos.25891, 25894, 25999 of 2010 and 3823 of 2012 and the Division Bench of this Court by order dated 11.02.2013 disposed of the said batch of writ petitions directing the State Government to reconsider the Act itself. However, the order of the Division Bench was challenged before the Apex Court in SLP (Civil) No.10475 of 2013 and the Apex Court passed an interim order directing the respondent - State of Andhra Pradesh not to take coercive steps against the petitioner.

During hearing learned Public Prosecutor submitted that the State may be permitted to take appropriate steps whenever SLP (Civil) No.10475 of 2013 is disposed of by the Apex Court. In view of the request made by the Public Prosecutor for the State of Andhra Pradesh, I deem it appropriate that, without touching the merits in the contentions of both parties, liberty is given to the State of Andhra Pradesh to take appropriate steps after disposal of SLP (Civil) No.10475 of 2013 by the Apex Court.

MSM,J Crl.P_9004_2013 With the above observations, the petition is disposed of. No costs.

The miscellaneous petitions pending, if any, shall also stand closed.
