This Criminal Petition is filed under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioner/Accused No.3 seeking bail in the event of his arrest in connection with Crime No.872 of 2023 on the file of Jadcherla Police Station, Mahbubnagar District, registered for the offences under Sections 147 and 307 r/w.149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State. Perused the record.

The complaint was lodged on 28.12.2023 stating that this petitioner and others had attacked the de-facto complainant's son sprinkling chili powder in his eyes and beat him indiscriminately. There were around 20 persons. On the basis of the said complaint, crime was registered and A-1 and A-4 were arrested. 4.
Learned counsel appearing for the petitioner would submit that there was altercation in between two groups and injuries were sustained by A-2 and others. Except stating that this petitioner was present in the group, no specific allegation is leveled against him.

As seen from the complaint, no overt acts are attributed to this petitioner. It is alleged that 20 persons have attacked the de-facto complainant's son. It appears that there are disputes regarding land, due to which altercation ensued. 6.
Keeping in view that this petitioner is a student aged around 20 years and no specific overt acts are attributed to him in the complaint, the relief of anticipatory bail can be considered, subject to following conditions:-
1) The petitioner/Accused No.3 is directed to surrender before the Station House Officer, Jadcherla Police Station, Mahbubnagar District, on or before 09.02.2024. Upon such surrender, the said Station House Officer shall release the petitioner/Accused on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.3 shall appear before the concerned Station House Officer at 10:00 a.m. one every Monday for a period of four weeks for the purpose of investigation and thereafter, as and when required.
3) The petitioner/Accused No.3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
