C O M M O N O R D E R In this batch of writ petitions, interim orders were passed directing the respondents to consider the cases of the petitioners on priority basis for appointment to the posts of Luscars in existing or in future vacancies as per law and to pass appropriate orders.
Petitions were filed by the respondents to vacate the said orders. Complaining of willful disobedience to the said orders, contempt cases were also instituted.
It is now stated by Sri Srinivasa Rao Velivela, learned counsel for the petitioners, and the learned Government Pleader for Irrigation and Command Area Development, that benefit has been extended to some of the petitioners pursuant to the interim orders, on the ground that they are covered by the earlier order passed by this Court in W.P.No.764 of 1985 and that speaking orders have been passed in the case of those who were not granted such benefit. In the light of this development, as the orders passed by this Court were only to consider the cases of the petitioners, there is no cause for complaint in so far as the contempt cases are concerned. The rejection of the cases of any of the petitioners herein would give rise to a fresh cause of action which would have to be addressed separately by way of independent proceedings in accordance with law. The same cannot be made the subject matter of
these contempt cases or writ petitions.
In that view of the matter, the contempt cases and writ petitions are closed leaving it open to such of the petitioners who are aggrieved by the subsequent orders passed by the respondents to seek redressal by way of appropriate independent proceedings in accordance with law. Pending miscellaneous petitions shall also stand closed. No order as to costs.
