This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.1 seeking to enlarge him on bail in connection with Crime No.1357 of 2025 of L.B.Nagar Police Station, Rachakonda Commissionerate. The offence alleged against the petitioner is punishable under Section 18 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, NDPS Act).

The case of the prosecuiton is that on 30.12.2025 on credible information, the police L.B. Nagar conducted a targeted operation at L.B.Nagar X Roads, where they intercepted the petitioner coming from Bajaj Pulsar. On interrogation, the petitioner voluntarily disclosed that 312 Grams of Opium were concealed inside the bike. On search they found that the accused were in possession of 312 Grams of Opium, which was concealed inside the bike tank cover. The police recovered the contraband along with phone under panchanama and registered a case in Crime No.1357 of 2025. 3.
Heard Sri Mohammad Fayaz, learned counsel representing Sri R.Thirupathi, learned counsel for the petitioner-accused No.1 and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondentState. 4.
The contention of learned counsel for the petitioner/accused No.1 is that the petitioner is innocent of the offence alleged against him; that the petitioner is in judicial custody since 30.12.2025; that the seized contraband is 312 Grams, which is intermediate quantity. He further submits that material part of the investigations is completed
- 3 - and requested this Court to grant regular bail to the petitioner/accused No.1.

On the other hand, the learned Additional Public Prosecutor opposed the same and submits that the offence alleged the petitioner is under NDPS Act; that though the seized contraband is on intermediate quantity, at this stage, investigation is not yet completed and hence, he prays to dismiss the Criminal Petition.

Considering the submissions made by learned counsel on either side and on perusal of the entire material on record, the petitioner is arrayed as accused No.1 and he is in judicial custody since 30.12.2025. The contraband seized from the possession of the petitioner is 312 Grams which is intermediate quantity. According to the learned Additional Public Prosecutor there are no other cases pending against the petitioner. Considering the quantity of contraband seized from the possession of the petitioner and as no other cases are pending against the petitioner, this Court opines that it is appropriate to grant regular bail to the petitioner, subject to the following conditions:
- 4 - (i) The petitioner-accused No.1 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned I Additional Judicial Magistrate of First Class, L.B.Nagar.
(ii) On such release, the petitioner-accused No1 shall appear before the concerned SHO at 11:00 a.m., on every Monday and Friday for a period of eight
(8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
(iii) The petitioner-accused No.1 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
