Sunnam Raju v. The State Of Telangana
SMT JUSTICE T.RAJANI CRIMINAL PETITION No.736 OF 2018 ORDER:
This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is accused No.2, in Crime No.646 of 2017 on the file of the Station House Officer, Rajiv Gandhi International Airport Police Station, Shamshabad, Cyberabad District. The offences alleged are under Sections 420, 468 and 471 of I.P.C.
2.
Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.
The allegations against the petitioner are that the petitioner/accused No.2, representing himself to be working in M.R.O. office, approached the de-facto complainant, offering to allot patta in a Government land in Survey No.29/B, Shamshabad village, and he along with accused No.1 collected huge amounts from the victims. 4.
Learned counsel for the petitioner further submits that the incident occurred in the year 2014 and the complaint is lodged in the year 2016. 5.
It is possible that the de-facto complainant would have waited with a fond hope that the promise made by the petitioner would be fulfilled. Hence, the delay does not affect the case of the prosecution. 6.
Hence, in view of the nature of allegations made against the petitioner, it is considered as not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner/accused No.2 is directed to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work.
TR,J Crl.P. No.736/2018 Accordingly, with the above observation, this Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
