HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7875 OF 2016 ORDER:

This writ petition is filed challenging the action of respondent No.2 in not releasing the essential commodities to the petitioner's Fair Price Shop No.939/990 of Circle-IX, Srinivasnagar, Secunderabad and consequently direct respondent No.2 to release essential commodities to the petitioner's fair price shop as usual. It is the case of the petitioner that a show-cause notice dated 01.03.2016 was issued to the petitioner alleging certain irregularities. In spite of the fact that the petitioner's fair price shop authorization is subsisting till 31.03.2019, no enquiry and no final orders have been passed as on date and the authorization issued in favour of the petitioner is neither suspended nor cancelled. In those circumstances, petitioner seeks a writ of mandamus as stated above.

Having considered the submissions made on behalf of the petitioner and considering the fact that the show cause notice was issued on 01.03.2016 and also considering the fact that the authorization of the petitioner is subsisting till 31.03.2019, I am of the view that no useful purpose would be served by keeping the writ petition pending.

In those circumstances, there shall be a direction to the respondent authorities concerned to complete the enquiry after considering the explanation, if any, submitted by the petitioner and pass final orders within a period of four weeks from today.

With the above direction, the writ petition is disposed of. No order as to costs. In view of the disposal of the main writ petition, Miscellaneous petitions, if any pending in the writ petition, shall also be closed. ______________________________ CHALLA KODANDA RAM, J.
