This petition is filed for a writ of Mandamus declaring the in-action of the respondents 2 and 3 herein in considering the representation dated 08.05.2014 acknowledged on 14.05.2014 of the petitioners regarding the illegal occupation of the road space and erected one wooden shop by the 4th respondent bearing H.No.3-125, Gangaram of Chandanagar Village, Serilingampally Mandal, Ranga Reddy District as being illegal and arbitrary and consequently direct the respondents 2 and 3 to remove the illegally laid wooden shop by the 4th respondent bearing H.No.3-125, Gangaram of Chandanagar village, Serilingampally Mandal, Ranga Reddy District. Heard Sri K.Rama Murthy, learned counsel for the petitioners and the learned G.P.for Municipal Administration, appearing for the first respondent and Smt.Dr.Y.
Padmavathi, learned standing counsel for respondents 2 and 3. The grievance of the petitioners is that the 4th respondent has erected a wooden shop on the road and though the petitioners filed a representation to the respondent authorities in the year 2014, no action is being taken. Hence, the present writ petition is filed.
On the other hand, learned standing counsel submits that action has already been initiated and that the said construction has been removed. In view of the same, the cause in the writ petition does not survive and accordingly, the present writ petition is closed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
