HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Crl.P.M.P.No.2499 of 2015 in Crl.P.No.16072 of 2014 and Criminal Petition No.16072 of 2014 COMMON ORDER:
The defacto complainant and her counsel Sri P.Animi Reddy, are present. A.1 to A.3 and their Counsel Sri A. Jaya Sankara Reddy are present.
Heard both sides and perused the petitions.
On the report given by the defacto complainant, the Police of Nandyal II Town P.S, Kurnool registered a case in Crime No.153/2014 for the offences under Sec.420, 323, 506 r/w 34 IPC against the accused.
The allegations are that A.1 and complainant are known persons and on the inducement of A.1 to invest money in real estate business, the defacto complainant invested Rs.5,00,000/- in December, 2013 with the hope that the A.1 would purchase some land at Kurnool City which was promised to yield good value in future but later A.1 did not do so. While-so in June, 2014 the complainant fell in need of his money and so on 30.06.2014 at about 6:00pm complainant went to the house of A.1 to ask about his money and on that A.1 and his two sons i.e, A.2 and A.3 grew wild against the complainant and bet him with hands and legs and necked him out of the house and hence the complaint.
The investigation is reported to be pending.
While so, the defacto complainant, accused and their counsel present in Court today and submitted that at the intervention of elders they have amicably settled all their disputes and they want to live peacefully and as such the defacto complainant has no objection for quashment of the proceedings in Crime No.153/2014 of Nandyal II Town P.S and hence this Court may be pleased to accord permission to compound the offence and quash the proceedings in the interest of justice.
Having regard to the above submission of the parties and in view of the fact that the matter relates to financial dispute wherein the parties have amicably resolved their disputes and want to live peacefully and also considering that no useful purpose will be served even if the investigation is ordered to be continued since they have compromised and following the decision reported in Gian Singh vs. State of Punjab and another[1], this petition is allowed and permission is accorded to the parties to compound the offence and consequently proceedings in Crime No.153/2014 of Nandyal II Town P.S, Kurnool are quashed in the light of joint compromise memo filed by the parties.
In the result, both the petitions are accordingly allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
