Burgu Srinivasulu v. The State Of Telangana

THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM W.P.No.2531 of 2019 O R D E R:

This writ petition is filed seeking to declare the action of respondent No.2-Executive Magistrate & Tahsildar, Manugode Mandal, Nalgonda District in issuing the notice dated 05.02.2019 directing the petitioner to pay a penalty of Rs.1,00,000/-, in default, to send him to prison, as illegal and arbitrary. When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned Government Pleader for Prohibition and Excise that the issue in the present writ petition is squarely covered by the order of this Court in W.P.No.5038 of 2017 dated 14.02.2017.

Following the above said order and for the reasons recorded therein, this writ petition is also allowed in terms thereof, setting aside the impugned notice.
