THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.2055 OF 2018 ORDER:

When the matter is taken up, written instructions, dated 29.01.2018, furnished by the Sub-Inspector of Police, Penumuru Police Station, Chittoor District are placed on record by the learned Government Pleader for Home. The said instructions read as under:- "It is submitted that after communication of the Writ Petition, the 3rd respondent Station House Officer, Penumuru Police Station, Chittoor District verified the station records whether the petitioner sent the alleged complaint dated 05.09.2017 stated to have been sent through post and the station record revealed that as of now, no complaint was received. As per the records of the Station, the Police has not received the complaint. But after the writ petition, the 3rd respondent deputed the staff to the house of the petitioner at the given address, but the petitioner not available.

It is submitted that as per the contents of the complaint dated 05.09.2017, it revealed that there was a civil dispute between the petitioner and the respondents 4 and 7 with regard to the land in Sy.No.11/A, admeasuring Ac.0.45 cents, situated at Kalavagunta Village, Penumuru Mandal, Chittoor District and the respondent No.4 filed O.S.No.490/2010 against the petitioner herein with regard to the above said land. As the matter relates to civil in nature, hence no FIR is registered. In this regard the 3rd respondent tried to intimate the same to the petitioner, but he was not available at the given address.

It is submitted that the contention of the petitioner that after sending the alleged complaint dated 05.09.2017, the petitioner visited the Police Station is not correct and baseless. It is submitted that whenever

the petitioner approaches the Police Station along with relevant documents, necessary action will be taken as per law. It is submitted that the petitioner instead of approaching the Police Station along with relevant documents, filed the present writ petition with baseless allegations."

The said instructions are placed on record and accordingly, the Writ Petition is disposed of, keeping it open to the petitioner herein to avail the remedies available to him under law. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
