HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION (TR) No.749 of 2017 ORDER:

This writ petition is disposed of at the stage of admission with the consent of learned counsel for the respective parties. This writ petition is filed seeking the following relief :- " .....declare the action of respondent Nos.2 and 3 in not renewing the contract of the applicant as unjust, unreasonable and irrational and violative of Article 14 of the Constitution of India and consequently direct the respondents to renew the contract of the applicant as Junior Lecturer in Chemistry......" .

Heard Mr.P.V.Krishnaiah, learned counsel for petitioner and the learned Government Pleader for Services-I. It has been contended by the petitioner that he was appointed as a Junior Lecturer in Chemistry on contract basis with the respondents during October, 2009 and he has been discharging his duties to the best satisfaction of his superiors and everyone concerned. He was allowed to continue on contract basis for the academic year 2012-13. Thereafter, without assigning any reasons, the respondents have not renewed his contract period. In those set of circumstances, the petitioner has approached the then A.P.Administrative Tribunal and filed O.A.No.5416 of 2013 and subsequently the said O.A. is transferred to this Court. Learned counsel for the petitioner contends that though there are vacancies the case of the petitioner is not considered for re-engaging him as Lecturer on contract basis. Therefore, appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner for re-engaging

him as Lecturer in Chemistry on contract basis in any of the existing vacancies.

Learned Government Pleader appearing for the respondents contends that if the petitioner submits fresh representation, the respondents would consider the same and pass appropriate orders in accordance with law.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioner to submit a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order seeking re-engagement as Lecturer in Chemistry on contract basis in any of the existing vacancies. Upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law within a period of eight weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.
