THE HONOURABLE DR.JUSTICE G. RADHA RANI CRIMINAL PETITION No.1243 of 2024 O R D E R:

This Criminal Petition is filed by the petitioner - A4 under Sections 437 and 439 of Code of Criminal Procedure (for short "Cr.P.C.) for grant of regular bail in Crime No.11 of 2024 of PS Film Nagar, Hyderabad for the offences under Sections 8(c) read with 22(b), 27 of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

The case of the prosecution was that on 05.01.2024 at 1400 hours, the SubInspector of Police, Film Nagar PS received credible information about a person in possession of Narcotic Substance Drug i.e. MDMA coming to Senor Valley Junction. On receiving the said information, he along with his staff proceeded to the said place and apprehended accused No.4 and seized one gram of MDMA drug found in a zip lock plastic cover and an I-phone 15 pro max from the possession of accused No.4 and registered the above Crime.

The persons who supplied the drug to accused No.4 were shown as A1 to A3 and as absconding.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor.

The learned counsel for the petitioner submitted that the petitioner was shown as a consumer, but not as a supplier. He was a private employee having old aged parents, wife and small school going children. The entire investigation pertaining to the petitioner was completed. He was no more required for the purpose of investigation and prayed to enlarge the petitioner on bail. 6.

The learned Additional Public Prosecutor opposed grant of bail to the petitioner - A4.

Considering that only an intermediary quantity of 1gram of MDMA Drug was alleged to be seized from the possession of the petitioner - accused No.4, which was stated to be obtained by him for his personal consumption and there were no criminal antecedents recorded against the petitioner, it is considered fit to enlarge the petitioner on bail on his executing a personal bond for Rs.25,000/- with two sureties each for the like sum to the satisfaction of the XVII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

In the result, this Criminal Petition is allowed. As a sequel, miscellaneous applications pending in this petition if any shall stand closed.
