THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.7579 of 2017 ORDER:

This Criminal Petition is filed, by the petitioner, under Sections 437 and 439 Cr.P.C., seeking bail in Crime No.32 of 2017 on the file of the Station House Officer, Bathalapalli Police Station, Ananthapur district, registered for the offences punishable under Sections 366 (A), 376 and 506 of IPC and Sections 3 and 4 of POCSO Act, 2012. The learned counsel for the petitioner submitted that the petitioner has been in jail since 27.03.2017, therefore, it is a fit case to grant bail to the petitioner.

Per contra, the learned Additional Public Prosecutor submitted that on behalf of the prosecution P.Ws.1 to 8 were examined and trial will be closed within a short time.

A perusal of the record reveals that the petitioner is facing trial in S.C.No.220 of 2017 on the file of the Court of the I Additional District & Sessions Judge, Ananthapur for the offences stated above. From the record it is evident that the petitioner filed Crl.M.P.No.383 of 2017 on the file of the Court of the I Additional District & Sessions Judge, Ananthapur and the same was dismissed on 30.06.2017 on the ground that investigation is still in progress. Again the petitioner filed another petition vide Crl.M.P.No.456 of 2017 and the same was also dismissed on 10.08.2017 on the ground that schedule was given. The learned Additional Public Prosecutor, on instructions, submitted that in this case P.Ws.1 to 8 were already examined and the trial Court is taking up the matter day to day. Taking into consideration the progress of the trial, I am of the considered view that this is not a fit case to grant bail to the petitioner.

In the result, the petition is dismissed. However, the trial Court is hereby directed to dispose of the S.C.No.220 of 2017 as expeditiously as possible.
