SMT JUSTICE T.RAJANI CRIMINAL PETITION No.743 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioners, who are accused Nos.2 and 3, in Crime No.150 of 2017 on the file of the Station House Officer, Nadigudem Police Station, Suryapet District. The offences alleged are under Sections 498-A R/w.34 of I.P.C. and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Heard the learned counsel for the petitioners, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

Learned counsel for the petitioners submits that accused No.1 in this case was already enlarged on bail and that the dismissal of the earlier bail petition, insofar as these petitioners is concerned, was on the ground that accused No.1 was not yet arrested. But, a perusal of the order, passed by this Court in Criminal Petition No.11993 of 2017, shows that this Court, while considering that there are specific allegations against these petitioners, refused to grant anticipatory bail to them.

Hence, in view of the above, this Court is not inclined to grant anticipatory bail to them. However, the petitioners/accused Nos.2 and 3 are at liberty to surrender the before the lower Court and obtain regular bail. The lower Court shall dispose of the bail application expeditiously, preferably on the same day, subject to pressure of other work.

Accordingly, with the above observation, this Criminal Petition is dismissed. As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
