THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3605 OF 2016 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.353 of 2015 on the file of the XIII Additional Chief Metropolitan Magistrate, Mahila Court at Hyderabad.
Heard and perused the material available on record. The petitioner is alleged to have committed the offence punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
Considering the facts and circumstances of the case and the allegations made in the complaint, this Court is not inclined to grant the relief sought by the petitioner.
At this stage, the learned Counsel for the petitioner submitted that the petitioner apprehends arrest since NBWs and look out notice were issued against him.
In view of the above submission, the petitioner is directed to surrender before the trial Court and move an application to recall NBWs and the look out notice issued against him. On such application being filed, the trial Court is directed to recall NBWs and look out notice issued against the petitioner on the same day and release him on bail on condition of the petitioner executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with one surety for the like sum to the satisfaction of the trial Court. Till then, the operation of look out notice is suspended. The petitioner is directed to appear before the trial Court on all hearing dates in the above C.C. Accordingly, the Criminal Petition is disposed of.
