THE HON'BLE SRI JUSTI CE U.DURGA PRASAD RAO SECOND APPEAL No.57 of 2004 JUDGMENT:
The learned counsel for the appellant addressed a letter, dated 11.10.2017, to the Registry, seeking permission of the Court to withdraw the Second Appeal with liberty to the appellant to file a fresh suit.

The Second Appeal is, accordingly, dismissed as withdrawn with liberty to the appellant as sought for.
