THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2118 of 2018 O R D E R:

This writ petition is filed complaining the inaction of respondent No.3 in taking action on the complaint, dated 04.12.2017 said to have been submitted by petitioner against the Sarpanch of Kommala Gram Panchayat alleging certain irregularities.

Learned counsel for the petitioner submits that respondent No.3 is duty bound to act on the said complaint under Section 249 of the Andhra Pradesh Panchayat Raj Act by causing enquiry and taking necessary action.

Learned Government Pleader for Panchayat Raj placed before this Court, the written instructions received from respondent No.3 and they read as under:

"I submit that, initially complaint was filed by Sri B.Srinivas R/o.Kommala of Jajireddygudem Mandal Gram Panchayat against Sri Kuntla Sunder Reddy, Sarpanch Gram Panchayat Alair of Alair Mandal on 06.12.2017. Upon which the Extension Officer (PR&RD) Thirumalagiri has been directed to enquire into the matter and submit his detailed report vide this Office Memo.No.741/2017-B1(Pts), dated 15.12.2017.

Further, the Extension Officer (PR&RD), Thirumalagiri has requested to exempt the above enquiry due to his ill-health.

It is further submitted that, due to the request of the Extension Officer (PR&RD), Thirumalagiri, an Enquiry Officer

in case has been modified to Extension Officer (PR&RD), Mellacheruvu and directed to enquire into the matter and submit his detailed report vide this Office Memo No. 741/2017-B1(Pts), dated 13.01.2018.

In view of the above, the Government Pleader, for Panchayat Raj & Rural Employment has requested to submit the above facts to Hon'ble High Court and requested to grant 15 days time for submitting detailed report in this matter. I therefore, request you kindly to defend the case on behalf of all the respondents and see that the interest of the Government is well protected."

From the above, it is clear that respondent No.3 having taken note of the complaint said to have been submitted by the petitioner, directed the authority concerned to enquire into the matter and submit a report.

In view of the above, there is no need to keep this writ petition pending as the action has already been taken. Hence, the writ petition is disposed of directing the respondent authorities to complete the entire exercise within a period of four (4) weeks from the date of receipt of a copy of this order.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J Dt:25.01.2018 kdl
