HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.15469 of 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondentspolice. 2.

The prayer sought in the writ petition is as under: " ... Hon'ble Court may be pleased to issue a writ, order or direction, more particularly one in the nature of writ of mandamus to declare the action of the respondent No. 4 in not taking action on the petitioner's report dated 28.04.2014 seeking to take proper and appropriate action against the 5th respondent who is petitioner's husband Dr. P. Pranay Sandeep Kumar for cheating the petitioner and to investigate the matter for making all the false fabricated and forged documents of his qualification certificates as petitioner's husband is doing as public servant by cheating the Government with forged qualification certificates and in order to protect the funds of Government as well as to save the lives and health of public at large as being illegal, arbitrary, unconstitutional and consequently direct the respondent No.4 forthwith to take action on petitioner's report dt. 28.04.2014 and pass such other order or orders as the Honourable deems fit and proper in the circumstances of the case."

The 4th respondent filed counter-affidavit denying the averments made in the affidavit filed in support of the writ petition and contended inter alia that pursuant to the petition/ application submitted by the petitioner on 28.04.2014, a case in Crime No.468 of 2014 was registered. The learned Government Pleader also brought to the notice of this Court that after completion of investigation, charge sheet was also filed. The same was taken on file as C.C.No.1603 of 2017. The said matter was posted to 25.02.2020 for appearance of the accused.

In that view of the matter, this Court is of the opinion that no further cause would survive in the writ petition.

Accordingly, the Writ Petition is closed. However, liberty is given to the petitioner to raise objections, if any, by way of a protest application as per law. No order as to costs. Miscellaneous petitions, if any, shall stand closed. ___________________ P. KESHAVA RAO, J Date: 04.12.2019.
