Mohd. Jahangeer, v. The State Of A.P.,
THE HONOURABLE SRI JUSTICE RAJA ELANGO CRL.P.M.P.No.13143 OF 2013 & CRIMINAL PETITION No.14657 OF 2013 ORDER:
The above Criminal Petition is filed by the petitioner-accused under Section 482 Cr.P.C., seeking to quash the proceedings against him in S.C. No.481 of 2011 on the file of the V Additional Metropolitan Sessions Judge, Hyderabad, arising out of Crime No.23 of 2011 on the file of Kanchanbagh Police Station, Hyderabad, registered for the offences punishable under Sections 354 and 509 IPC. When this matter is taken up, the petitioner and the respondents 2 to 4, (respondent Nos.2 and 3 being minors represented by their father-complainant), appeared before this Court and submitted through their respective Counsel that they have entered into a compromise and therefore, the proceedings in the above case may be quashed. They filed the photostat copies of their identity cards. They also filed the above Crl.M.P., seeking to permit them to compromise the case and to quash the proceedings. The 4th respondent - complainant has also filed an affidavit before this Court and both the parties filed a joint memo.
Having regard to the fact that now the dispute between the respondent 2 to 4 and the petitioner has been settled amicably, this Court is of the view that no useful purpose would be served in continuing the prosecution launched against the petitioner for the above mentioned offences.
Considering the above circumstances, this Court feels that it is a fit case to quash the proceedings against the petitioner herein. Hence, permission is accorded and above Crl.M.P. is ordered. Accordingly, the Criminal Petition is allowed quashing the proceedings against the petitioner in the above S.C. No. 481 of 2011
on the file of the V Additional Metropolitan Sessions Judge, Hyderabad, arising out of Kanchanbagh Police Station, Hyderabad. Consequently, miscellaneous petitions pending, if any, shall stand closed.
