THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 20531 OF 2004 ORDER:

When the matter is taken up for hearing, none appeared for the petitioner in spite of the fact that the writ petition is listed under the caption of dismissal.

Learned counsel for respondent No. 1-workman contended that respondent No. 1-workman is not interested to pursue the case as he is no more interested to get reinstated in pursuance of the orders passed by the authority under Shops and Establishments Act and contended that the cause in the writ petition would not survive and contended that the writ petition be dismissed as infructuous.

This Court having considered the submission made by learned counsel for respondent No. 1-workman is of the considered view that the writ petition has become infructuous. The writ petition is accordingly dismissed as infructuous. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
