THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.3418 OF 2008 ORDER:

This writ petition is filed challenging the action of the respondents in notifying the property admeasuring 2300 square yards comprised in plot Nos.19, 20, 23, 24, 25 and 26 situated in survey No.205 of Gudimalkapur Village, belonging to the petitioners, for sale in a public auction treating it as the Government land, and for a consequential direction to the respondents not to interfere with the said property. When the matter is taken up for consideration, learned counsel for the petitioners produced before this Court a copy of the order in W.P.No.3507 of 2008, dated 09.07.2008, wherein this Court closed the writ petition at the stage of admission after recording the averments made in the counter affidavit. This Court also verified the averments made in the counter affidavit, which are identical. Now in the counter affidavit it is stated that no alienation proposals have been submitted for allotting the land to the A.P.Housing Board and the land was not available for conducting auction.

In view of the above, this writ petition is also closed recording the averments made in the counter affidavit. Miscellaneous petitions, if any pending, in this writ petition, shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 13.06.2017 pln
