THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.20404 OF 2007 ORDER:

This writ petition is filed by the petitioners seeking a direction to the respondents not to disburse the compensation amount to the land owners on the ground that they have obtained loans from the second petitioner society keeping the lands as a security and if the compensation is paid to them, it is difficult for the second petitioner society and its financing bank (1st petitioner) to recover the amounts from the borrowers whose lands are mortgaged to the second petitioner society without producing no-objection certificates from the petitioners.

This Court, while admitting the writ petition on 27.09.2007, passed an interim order, directing the respondents not to disburse the compensation amount to the borrowers of the petitioners, without producing no-objection certificates from them for the lands acquired in pursuance of the Declarations issued under Section 6 of the Land Acquisition Act, 1894.

Now, it is represented by the learned counsel for the petitioners that loans were recovered from the borrowers and no-objection certificates were issued for the amounts of which compensation is being paid to the borrowers/land oustees, and hence, no further orders are required in this writ petition.

Recording the said submission of the learned counsel for the petitioners, the writ petition is closed. No costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
