Heard learned counsel for petitioner/A3.

2) Petitioner filed this petition under Section 482 Cr.P.C. seeking to recall NBW issued against him and others by the III Metropolitan Magistrate, Cyberabad, L.B.Nagar, Hyderabad in C.C.No.190 of 2016 in his order dated 02.06.2017.

3) The submission of learned counsel for petitioner is that in Crl.P.No.14257 of 2015 dated 04.01.2015 this Court ordered not to arrest A2 and A3 pending investigation. After investigation police have laid charge sheet against the petitioner and other accused which fact was not known to the petitioner. Thereafter, the trial Court at the first instance issued NBW. Learned counsel for petitioner thus prayed to order re-call of NBW. 4) Having regard to above submission, petitioner/A3 is directed to appear before the trial Court and move an application for re-call of NBW in which case the trial Court shall re-call the NBW on the same day. 5) Criminal Petition is accordingly disposed of.
