O R D E R :
This Civil Revision Petition is filed questioning the order dated 4/2/2010 in I.A.No. 495 of 2009 in O.S.No. 43 of 2008 on the file of the Court of Senior Civil Judge, Addanki, whereunder the petition filed by the petitioner under Section 45 of Evidence Act seeking to send the suit pronote dated 7/7/1996 containing the part payment endorsements to the Government Handwriting and Finger Prints Expert for his examination and opinion in respect of the signatures thereon was dismissed.
2. This Court while disposing the Civil Revision Petition by order dated 23/8/2012 remanded the matter to the court below for fresh consideration within a period of four weeks from the date of receipt of a copy of the order.
3. Thereafter, CRPMP>No. 1644 of 2013 has been filed seeking to extend the time granted on 23/8/2012 in CRP.No. 1353 of 2010 for a further period of two months for disposing of I.A.No. 495 of 2009 in O.S.No. 43 of 2008 and the same is pending.
4. The Registry of this Court has seen from the computer list that the suit, OS.No. 43 of 2008 itself was disposed of on
18/9/2014. Accordingly the present Civil Revision Petition has become infructuous.
5. The Civil Revision Petition is dismissed as infructuous. No costs.
6. As a sequel, miscellaneous petitions if any pending in this Civil Revision Petition shall stand closed. ____________________________ JUSTICE SURESH KUMAR KAIT.
