HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7622 of 2017 ORDER :

Heard learned counsel for the petitioners/ A2 to A4 in S.C.No.69 of 2017 on the file of the Assistant Sessions Judge, Gudivada, Krishna District, which is outcome of Crime No.202 of 2015 of Mudinepalli Police Station, Krishna District, registered the report of one V.Sivaganga, D/ o Seshagiri Rao, for the offences punishable under Sections 417, 376(2), 376-N, 506 r/ w 34, 109 I.P.C.

The police after investigation filed final report and the learned Magistrate allotted P.R.C.No.3 of 2017 and committed the case to the Court of Sessions by taking cognizance for the said offences against the accused and the Court of Sessions allotted S.C.No.69 of 2017 and it is in the stage of pre-charge enquiry.

There is no entire Part-II Case Diary filed because statements of LWs.3 to 11 not filed but for, LWs.1 and 2, leave about LWs.12 and 13 are the Doctors and LWs.14 and 15 are the investigating officers.

Having regard to the above and since the material is insufficient, there is nothing to interfere with the process, but for, left open the defences to raise before the trial Court by filing a discharge application under Section 227 Cr.P.C. The petitioners are at liberty to file application for one to represent others under Rule 37 of the Criminal Rules of Practice and the learned Sessions Judge shall consider subject to directions of personal appearance as and when required. Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
