CRLP.No.866 ol 2O2O Petition under Section 438 of Cr.P.C. praying that in the circumstances stated in the petition filed herein, the High Court may be pleased to enlarge the petitioner on bail in the event of his arrest in Crime No. 64912019 on the file of Malkajgiri Police Station in Secunderabad, in the interest ofjustice. The petition coming on for hearing, upon perusing the Petition, and the order of the High Court dated 1,4.02.2020 made in Crl.P. and upon hearing the arguments of Sri Vivek Jain Advocate for the Petitioner and of Public Prosecutor for the Respondent, the Court made the following
ORDER
Heard the learned counsel for the petitioner and the learned Public Prosecutor, Petitioner is A-3 in Crime.No.649 of 2019 pending on the file of Malkajgiri Police Station, Secunderabad. The offence alleged against the petitioner is under Section 306 r/w 34 IPC.
Petitioner herein has filed Crl.P.No.866 of 2O2O seeking anticipatory bail, This Court vide order dated L4,O2.2O2O granted anticipatory bail on imposition of certain conditions including the condition of depositing an amount of Rs,2,5O,00O/- within a period of 3O days from 14.02.2020. Learned counsel for the petitioner would submit that petitioner could not deposit the said amount in compliance of the said order since he is a petty businessman and due to present situation of Covid-19, pandemic' However, he has filed the present application on 16.03.202O itself.
,) As stated above, in the order dated 14,02.2o2o/ 30 days time was granted to the petitioner to pay the said amount. Even then, petitioner herein did not take any steps either to get extension of time for depositing the said amount or by depositing the said amount in compliance of the order. However, considering the fact that the petitioner is a petty businessman, he has filed the present LA, on 16.03.2020, the time granted in the order dated 14,02.2020 in Crl,P.No,866 of 2O20 to deposit the said amount of Rs.2,50,O0O/- is extended by one week from the date of receipt of a copy of this order.
