THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2620 of 2019 ORDER:

Heard learned counsel for the petitioner and Sri N. Praveen Kumar, learned Standing Counsel for the 2nd respondent. With their consent, the writ petition is disposed of at the admission stage. 2.

This writ petition is filed seeking issuance of writ of mandamus declaring the impugned notice Roc.No.F/987/2018-19, dated 11.01.2019, issued by the 2nd respondent in respect of the petitioner's water plant, as illegal and arbitrary. 3.

Though various grounds are raised, learned counsel for the petitioner submits that without giving an opportunity of submitting explanation or explaining his stand, the impugned notice came to be issued ordering stoppage of water plant.

The learned Standing Counsel would submit that treating the notice dated 11.01.2019 as show cause notice, the petitioner may submit his explanation, in which event, the authorities would deal with the same, in accordance with law.

Having regard to the above circumstances, the writ petition is disposed of directing the petitioner to submit his explanation by treating the notice dated 11.01.2019 as show cause notice, enclosing necessary documents, in which event, the authorities concerned shall pass orders, in accordance with law, after hearing

CKR, J W.P.No.2620 of 2019 all the concerned. Till such time, status-quo as on today, to be maintained with regard to the subject plant.
