Shri.M.S.Chopra, v. Government Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12753 OF 2012 DATED: 01.07.2015 Between:
Shri M.S. Chopra .. Petitioner And Government of Andhra Pradesh, Rep. by its Secretary, Home, Hyderabad, and others.
.. Respondents THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.12753 of 2012 ORDER:
The grievance of the petitioner was that the police authorities were not acting upon his complaint which was taken on file as Crime No.57 (wrongly mentioned as Crime No.56 in the writ petition) of 2012 registered on the file of Banjara Hills Police Station, Hyderabad. Relying on the written instructions dated 29.06.2015 received from the Sub-Inspector of Police, Banjara Hills Police Station, the learned Assistant Government Pleader for Home informed this Court that Crime No.57 of 2012 had been registered under Sections 406, 420, 506 and 120-B I.P.C. read with Section 34 I.P.C. on the file of Banjara Hills Police Station but ultimately, after due investigation, a final report was filed under Section 173 Cr.P.C. before the learned III Additional Chief Metropolitan Magistrate, Hyderabad, reporting that the case was 'civil in nature'. Notice to this effect was said to have been given to the complainant also.
In the light of the afore-stated development, it is for the petitioner to take appropriate action in accordance with law, in the event he is aggrieved by the final conclusion arrived at by the police authorities. Reserving liberty to the petitioner to do so, the writ petition is dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
