THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.31121 OF 2015 ORDER:
The writ petition is filed seeking a writ of mandamus declaring the inaction of the respondents 2 to 5 in closing the rowdy sheet No.53 opened against the petitioner in the year 2013 at the fifth respondent police station though no cases are pending against the petitioner, as illegal and arbitrary and consequently to direct the respondents 2 to 5 to close the rowdy sheet opened against the petitioner.
Heard and perused the material.
Learned counsel for the petitioner submits that the petitioner was falsely implicated in one case in 2013 and the same was ended in acquittal of the petitioner. He further submits that except the said case, no other case was registered and pending against the petitioner and as such, the petitioner made application dated 28.08.2015 for closure of the rowdy sheet and that the respondents did not close the rowdy sheet. Hence, he prays this Court to direct the respondents to close the rowdy sheet against the petitioner. Considering the facts and circumstances of the case, the petitioner is directed to make a fresh representation to the respondents 3 to 5 stating all the reasons seeking for closure of the rowdy sheet on or before 15.02.2017, and on filing of such application, the respondents 3 to 5 are directed to consider the representation and pass appropriate orders as expeditiously as possible, preferably within a period of two months from the date of application of the petitioner. Further, the respondents 3 to 5 are directed not to compel the petitioner to come to the Police Station.
The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
