The Court made the following:

This Writ Petition is filed for a Mandamus to declare the seizure of the petitioner's lorry, bearing registration No.AP 28 TE 9184, as illegal and arbitrary. The petitioner sought for a consequential direction to the respondents to release his vehicle forthwith.

After arguing the case, the learned Counsel for the petitioner requested for permission of the Court to withdraw the Writ Petition with liberty to his client to make an application before the competent authority for release of the seized lorry in terms of G.O.Ms.No.15, Industries & Commerce (Mines-I) Department, dated 19.02.2015, and approach this Court in the event, the seized lorry is not released.

The request of the learned Counsel for the petitioner is accepted and the Writ Petition is, accordingly, dismissed as withdrawn with liberty to the petitioner in terms of the prayer made.

As a sequel to dismissal of the Writ Petition, WPMP.No.49139 of 2015, filed by the petitioner for interim relief, is disposed of as infructuous.
