HON'BLE DR. JUSTICE B. SIVA SANKARA RAO WRIT PETITION No.19055 of 2017 ORDER:

The prayer in the writ petition reads as follows: "To issue a writ or order more particularly one in the nature of writ of mandamus or an appropriate writ or order declaring the inaction of the respondents 3 to 5 in taking appropriate action on the representation dated 22.04.2017 made for taking steps for protection of the ZPH School Site to an extent of Ac.2.62 cents in survey No.60/1, Vedullapalli Village, Bapatla Mandal, Guntur District, AP, is illegal, arbitrary, and unconstitutional and contrary to principles of the natural justice and pass such other order or orders."

Heard the learned counsel for the petitioner and learned Government Pleader for Panchayat Raj for respondent Nos.1 to 4 and also Sri G.Seshadri, learned standing counsel for 5th respondent and perused the prayer in the writ petition with the supporting affidavit and the representation of the petitioner dated 22.04.2017 sent by registered post.

It is the averment from the supporting affidavit that this is a earmarked school site in an extent of Ac.2.62 cents in S.No.60/1, Vedullapalli Village, Bapatla Mandal, Guntur District, and the respondents are allowing the encroachments and in taking steps to remove the same even.

It is the submission by the learned Government Pleader that the respondents will consider the representation and take appropriate action.

Having regard to the above and in the result, the Writ Petition is disposed of by directing the respondents to consider

Dr. SSRB,J said representation of the petitioner and pass appropriate orders therein within six (06) weeks from the date of receipt of a copy of this order and communicate the same to the petitioner. The further grievance of the petitioner is left open. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
