HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.75 of 2015 ORDER:
This petition is filed to withdraw O.P.No.1951 of 2014 from the file of Family Court, Ranga Reddy at L.B.Nagar, and transfer the same to Family Court, Kakinada.
2. First petitioner filed his affidavit contending that respondent herein filed O.P.No.1951 of 2014 against 2nd petitioner showing her age wrongly as 18 years though she is only 16 years. He contended that respondent herein filed W.P.No.24795 of 2014 before this Court to direct the Police to produce 2nd petitioner herein and this Court dismissed the writ petition on 27.08.2014 on the ground that the dispute is a matrimonial dispute and respondent herein has to approach competent forum. He further contended that respondent issued legal notice to 1st petitioner herein, for which a suitable reply was given, disputing all the averments. But, respondent filed O.P.No.1951 of 2014 with all false and frivolous allegations and that O.P is not maintainable. It is further contended because of that O.P.
, 2nd petitioner has to attend the Family Court, Ranga Reddy, and it is difficult for her and also for 1st petitioner to travel from Ramachandrapuram to Hyderabad for the purpose of defending O.P.No.1951 of 2014, therefore, prayed for transfer of O.P.No.1951 of 2014 from Family Court, Ranga Reddy to Family Court, Kakinada.
3. Respondent in spite of service of notice neither appeared in person nor through any advocate.
4. Heard arguments.
5. Considering the reasons stated in the affidavit, I feel that the request of petitioners can be considered. However, as there is no Family Court at Kakinada, I feel that the matter has to be transferred
to Family Court, East Godavari at Rajahmundry. Accordingly, O.P.No.1951 of 2014 is withdrawn from Family Court, Ranga Reddy at L.B.Nagar and transferred to Family Court, East Godavari at Rajahmundry.
6. Accordingly, the transfer C.M.P. is ordered. No costs.
