ORDER

This Criminal Petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused in Crime No.1073 of 2025 before the RGI Airport Police Station, Cyberabad, registered for the offence punishable under Sections 318(4), 336(3), 338, 340(2) of BNS, 12(1)(a)(b), 12(1)(A)(a)(b) of Passport Act, and 14A(b) of Foreigners Act.

The brief facts of the case are that on 18.11.2025 at 20:30 hrs, a complaint was received from Hari Prasad T, ACIO-II, stating that one passenger, namely Md. Ibrahim/petitioner holding Indian Passport No.V7544274, approached the arrival immigration counter by Flight No. EK-526. His passport contained two Afghanistan visas, which revealed different particulars: Name - Mohammad Ibrahim Khan, Father - Shah Wali Khan, Mother - Fatima Khan, Date of Birth - 06.05.1980. It was suspected that the passenger fraudulently procured Aadhaar, PAN, and subsequently obtained an Indian passport. The complainant requested registration of the case, investigation, and legal action. Accordingly, a case was registered in Cr. No. 1073/2025 under Sections 318(4), 336(3), 338, 340(2) of BNS, Sec. 12(1)(a)(b) of the Passport Act, and Sec. 14A(b) of FA, and investigation was taken up.

Heard Sri Azim Parbatani, learned counsel for petitioner, and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State. 4.

Learned counsel for the petitioners submitted that the petitioner has been foisted in the present crime without strict evidence, merely on the pretext of alleging non-Indian origin. The petitioner has filed records and documents substantiating his

Indian nationality, thereby exposing the prosecution's investigation as improper. He contended that the remand case diary reveals that the majority of the investigation has already been completed, including recording of confession statements, seizure panchnama, rough sketch, and witness statements. While averring that except for filing of the charge sheet, nothing remains for the prosecution, and the petitioner has been in judicial custody for 71 days, is willing to cooperate with the investigation, has no criminal antecedents, and is ready to furnish sureties, he prayed the Court to grant bail to the petitioner by allowing this criminal petition. 5.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, stating that there are serious allegations against the petitioner. Therefore, he prayed the Court to dismiss the criminal petition.

Having regard to rival submissions made, and on going through the material placed on record, it is noted that the petitioner has been in judicial remand since 18.11.2025. Considering the period of incarceration of the petitioner and the circumstances of the case in entirety, this Court deems it fit to grant bail to the petitioner, subject to the following conditions:

i.

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each, to the satisfaction of the X Additional District and Sessions Judge, Ranga Reddy District, at LB.Nagar.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioner shall abide by the conditions stipulated in Section 480(3) of the BNSS, earlier known as Section 437(3) of Cr.P.C.
