M. Kondal Reddy v. The State Of Telangana
HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NO.914 OF 2020 ORDER:
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure seeking quashing of the proceedings in C.C.No.1108 of 2017 on the file of the XXIV Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad. A charge sheet came to be filed against the petitioners/A-8 and A-9 for the offences punishable under Sections 341, 504 and 324 read with Section 34 of the Indian Penal Code. Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners/A-8 and A-9 restricts his prayer seeking dispensation of the presence of the petitioners/A-8 and A-9 before the trial Court on every date of adjournment.
The learned Public Prosecutor submits that since the identity of petitioners/A-8 and A-9 is not in dispute, their presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the facts and circumstances of the case, the personal appearance of the petitioners/A-8 and A-9 in C.C.No.1108 of 2017 on the file of the XXIV Metropolitan Magistrate, Kukatpally at Miyapur, Cyberabad, is hereby dispensed with except on the dates when their presence is specifically required by the Court.
With the above direction, the Criminal Petition is disposed of.
Miscellaneous applications, if any, pending shall stand closed.
