The Court made the following :

ORDER:

This Writ Petition is filed for the following substantive relief :

" ... issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the 2nd respondent in considering the case of the petitioner for appointment as fair price shop dealer on temporary basis as per the recommendations of the 3rd respondent vide letter dated 14.08.2008 for Shop No.22 of Atmakur village and Mandal, Sri Potti Sriramulu Nellore District, in the existing vacancy arose due to demise of petitioner's father-in-law, as arbitrary, illegal, unfair and unjust and consequently direct the 2nd respondent to consider the case of the petitioner for appointment as fair price shop dealer on temporary basis, duly considering the recommendations of the 3rd respondent for Shop No.22 of Atmakur village and Mandal, Sri Potti Sriramulu Nellore District as she is fully eligible and qualified ..." At the hearing, Ms. V. Vidyullatha Dasyam, learned Counsel representing Mr. P. Venkata Rao, learned Counsel for the petitioner, submitted that the cause in the Writ Petition does not survive for adjudication.

The Writ Petition is accordingly dismissed as infructuous.

As a sequel to the dismissal of the Writ Petition, interim order dated 25-2-2009 is vacated and WPMP No.4767 of 2009 is dismissed as infructuous.
