HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.2725 of 2020 ORDER :

This writ petition is filed aggrieved by action of respondent No.15 in passing the order dated 02-02-2019 vide Case No.D1/4724/2016 (RR), D1/33/2016 and D1/885/2016 wherein and whereby the revision filed by the petitioners under Section 9 of Telangana Rights in Land and Pattadar Passbooks Act in respect of subject land was dismissed.

Learned counsel for the petitioners submits that though the petitioners are in physical possession of the subject property, the revisional authority without considering the said aspect dismissed the revision.

Learned Assistant Government Pleader for Revenue says that since the petitioners are seeking correction of entries from 1954-55 onwards after long lapse of time, the revisional authority has rightly dismissed the revision and no exception can be taken warranting interference of this Court. The revisional authority dismissed the revision by way of impugned order, dated 02-02-2019. The relevant portion of the same reads as under:

" The Revision Petitioners seek for correction of entries in pattedars column in respect of land in Sy.No.476/2 to an extent of Ac.5-37 gts situated within thelimits of Elikatta village, Farroqnagar

Mandal, Ranga Reddy District from the year 1954-55 onwards to till date after a long lapse which is barred by limitation. The Law of Limitation is based on fundamental Public Policy Cannon that an unlimited and perpetual threat of litigation leads to disorder and confusion.

Though, neither the rule nor the Section 9 of Telangana Rights in Land and Pattadar Pass Books Act, 1971 and Rules, 1989 prescribes any time limit for exercise of the revision, such power must be exercised within a reasonable time.

In this case it is to be seen that no explanation is given by the petitioners as to why they sought correction of entries from the year 1954-55 onwards after long lapse of time. As such, I do not see any reason to entertain the writ petition and accordingly, the same is dismissed. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed.
