HON'BLE SRI JUSTI CE T. VI NOD KUMAR WRI T PETI TI ON NO.2576 OF 2020 ORDER:

The present Writ Petition is filed being aggrieved by the order of the 2nd respondent in Order No.316/TSEC-PR/2017-(1345), dated 12.01.2018, whereby the petitioner has been declared to be ineligible for a period of three years from the date of the impugned order to contest any election to be held for any office under the provisions of the Telangana Panchayat Raj Act, 1994.

Heard Sri Vadlakonda Ravi Kumar, learned counsel for the petitioner, and Sri P. Sudheer Rao, learned Standing Counsel for the State Election Commission, appearing for 2nd respondent, learned Government Pleader for Panchayat Raj for respondent Nos.1 and 3 and Sri G.Narender Reddy, learned standing counsel for the Gram Panchayat, appearing for respondent 5.

Learned counsel for the petitioner submits that the issue in the present writ petition is no longer res integra, in view of the judgment of this Court in W.P. No.17075 of 2018 and batch, which was disposed of by this Court, by a common order, dated 20.03.2019. Learned standing counsel for Election Commission and learned Government Pleader for Panchayat Raj do not dispute the same. Therefore, for reasons alike, the impugned order of the 2nd respondent, dated 12.01.2018, is hereby set aside and this Writ Petition is allowed in terms of the order, dated 20.03.2019, passed in W.P. No.17075 of 2018 and batch. No order as to costs.

As a sequel thereto, the miscellaneous petitions pending, if any, shall stand closed.
