THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.3882 OF 2017 ORDER:

This writ petition is filed, under Article 226 of the Constitution of India, for the following relief: "to issue a Writ, order or Orders more particularly one in the nature of a Writ of Mandamus declaring the action of the 3rd and 4th respondents in not accepting petitioner offer for compounding of offence registered against the petitioner under sections 135(b), 138(a)(b) and Section 150 of Indian Electricity Act 2003 in C.C.No. 46/2015 pending on the file of the Hon'ble I Additional District And Sessions Judge inspite of paying entire assessed loss amount of Rs.46,420/- and Rs.991/- as fixed by the respondents as illegal, arbitrary, unsustainable and contrary to the provisions of Indian Electricity Act 2003, and consequently direct the 3rd and 4th respondents to accept the petitioners offer for compounding the offence."

Heard Sri V.Siva Prasad Reddy, learned counsel for the petitioner and Smt.J.Koteswari Devi, learned standing counsel for the respondents.

When the matter is taken up, it is submitted by the learned counsel for the petitioner so also the learned standing counsel for the respondents that the issue in the present writ petition is squarely covered by the order of this Court in

AVSS,J W.P.No.3882 of 2017 W.P.No.30981 of 2014, dated 16.10.2014 and a copy of the same is also placed on record along with the writ petition as material paper.

Following the above said order and for the reasons recorded therein, this writ petition is also partly allowed, in terms thereof.

Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. No order as to costs.
