THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 2216 of 2018 O R D E R:
This writ petition is filed for the following relief: "....to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the respondents in not calculating and providing appropriate compensation for the petitioners' mango plantation when the said land i.e. Ac.8.10 guntas in Survey Nos.294, 296, 294-A, 296AA and 295 relating to petitioner No.1 and of an extent of Acs.4.39 guntas in Survey Nos.209 and 296 of Narlapur Village, Kollapur Mandal, Mahabubnagar District, relating to petitioner No.
2's mango plantation sought to be acquired for the purpose of construction of the Narlapur Balancing Reservoir under the Palamur Rangareddy Lift Irrigation Scheme as illegal, arbitrary and in violation of Articles 14 and 300-A of the Constitution of India and the Right to Fair Compensation Transparency in Land Acquisition, Rehabilitation and Settlement Act, 2013, and consequently direct the respondents to pay appropriate compensation to the petitioners in accordance with the positive age and yield of the trees over a period of time in accordance with its commercial viability which is approximately about 20 years...."
Today, when the matter is taken up for consideration, Sri Radhive Reddy, learned counsel, attached to the Office of the learned Advocate General, on instructions, submits that all aspects including the claim of the petitioners with respect to the mango garden would be considered while determining the compensation that is payable to the petitioners. Recording the above said submission, the writ petition is closed.
