Petitioner challenges final order dated 08.12.2016 as illegal, arbitrary and unconstitutional.

The second respondent through order dated 08.12.2016 demanded a sum of Rs.2,40,017/ - towards short fall billing and assessment for the period of effect in function of meter stoppage. 3.

Petitioner has statutory remedy of appeal before the Consumer Disputes Grievance Redressal Forum against the impugned demand. I am not prepared to exercise discretion and entertain the writ petition. Liberty is granted to petitioner to avail remedy of appeal before the statutory authority. However, petitioner is put to the condition of depositing a sum of Rs.1,20,000/ - (Rupees One Lakh Twenty Thousand only) within two (2) weeks from today and file appeal by enclosing a copy of receipt of payment. If the amount, as directed by this Court, is deposited, the respondents are directed not to disconnect power supply pending consideration of appeal by statutory authority. The appeal is directed to be disposed of within three (3) months from the date of filing.

The writ petition is disposed of. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
