THE HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.2586 OF 2019

O R D E R

The petitioner assails the action of the revenue authorities in issuing him notice dated 30.07.2018 in Form-II under Rule 3 of the Telangana Assigned Lands (Prohibition of Transfers) Rules, 2007. The learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court that pursuant to the impugned notice issued in July, 2018, the Tahsildar, Shankarampet Rural Mandal, Medak District, already passed a final order on 31.12.2018 under Section 4 of the Telangana Assigned Lands (Prohibition of Transfers) Act, 1977. A copy of the said order is placed on record.

Sri N.Manohar, learned counsel for the petitioner, would assert that the petitioner has not been served a copy of the aforestated order dated 31.12.2018 and this aspect of the matter was not even informed to him when he made a representation on 18.01.2019 to the Tahsildar, Shankarampet Rural Mandal, Medak District, which was received by the Office of the Tahsildar, Shankarampet Rural Mandal, Medak District, on the very same day.

In the light of the aforestated development, this writ petition, as framed, would no longer survive for consideration on merits independently. If the petitioner is aggrieved by the proceedings dated 31.12.2018 of the Tahsildar, Shankarampet Rural Mandal, he would necessarily have to challenge the same by way of independent proceedings in accordance with law. Leaving it open to the petitioner to raise all the aspects presently raised in support of any such challenge, the

writ petition is dismissed. Pending miscellaneous shall also stand dismissed. No order as to costs.
