THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.2599 of 2020 ORDER:

This writ petition is filed to declare the action of respondent No.4 in interfering and demolishing the pillars, drainage system and excavation of black top roads without following the due procedure contemplated under the provisions of Panchayath Raj Act, 2018 as arbitrary and illegal. 2.

Heard the learned counsel for the petitioner, learned Government Pleader for Panchayath Raj for respondents 1 to 3 and Sri G.Narender Reddy, learned Standing Counsel for Gram Panchayath for respondent No.4.

Learned Standing Counsel for Gram Panchayath for respondent No.4 submits that the fourth respondent authority has issued notice to the petitioner in proceedings No.01/GPA/2019, dated 18.11.2019 and subsequently issued another notice in Proceedings No.06/GPA/2019, dated 30.11.2019 with regard to the layout being developed by the petitioner without having necessary approvals and called upon the petitioner to submit a reply thereto within seven days from the date of receipt of a copy of the said notices.

It is also stated by the learned Standing Counsel that in response to the said notices issued, the petitioner has submitted his reply by letter dated 09.12.2019 and the respondent authorities would consider the same and pass orders in accordance with law.

Having regard to the said submissions and since it is stated that the petitioner submitted its reply to the notices issued by the fourth respondent, this Court is of the view that the fourth respondent authority

shall take into consideration the reply filed by the petitioner before passing any further orders in the matter. Till such time the fourth respondent passes an order, the respondent authority shall not take any coercive measures in the matter.

Accordingly, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
