THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.1169 OF 2024 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.4 in Crime.No.250 of 2023 on the file of Suryapet II Town Police Station, Suryapet District, registered for the offence under Section 20 (b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act'). 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of Suryapet II Town Police is that 2 kgs. of dry ganja was seized from A-1 and A-3. During the course of investigation, it was identified that this petitioner is also complicit in committing the offence along with A-1 and A-3. Accordingly, he was arrested.

This Court by order dated 12.10.2023 directed the release of A-3 on conditions.

Since nothing was recovered from this petitioner and his arrest was on the basis of confession of other accused, he can be released on bail, subject to following conditions:- i) The petitioner/Accused No.4 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum each to the satisfaction of the Principal Judicial First Class Magistrate Court at Suryapet.

ii) The petitioner/Accused No.4 after release shall appear before the concerned Station House Officer on every Monday at 10:00 a.m. for a period of eight weeks or until filing of charge sheet, whichever is earlier, for the purpose of investigation.

iii) The petitioner/Accused No.4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
