This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS) by the petitioners, who are arrayed as accused Nos.4, 8, 9 to 14, in the event of their arrest in connection with FIR No.6 of 2026 of Alladurg Police Station, Medak District, registered for the
offences punishable under Sections 109(1), 333, 118(1), 324(6), 352, r/w 3(5) of the BNS.

The case of the prosecution is that, on 17.01.2026, the de-facto complainant lodged a report before the police stating that, on the date of incident, accused Nos.1 to 13 and some others illegally trespassed into the house of de-facto complainant and forcefully opened the gate and started abusing the complainant in filthy language, upon which Avula Anjaiah, who is the injured tried to stop them and from them one Madduri Suresh Goud beat Anjaiah with a stone above left eye due to which he sustained severe blood injury and the complainant's wife also sustained injury to her right leg in the said quarrel. Hence, he requested for necessary action against all the accused, who came to their house to kill the de-facto complainant. Basing on the said complaint, the police registered a case for the above said offences. 3.
Heard Sri P. Srihari Nath, learned counsel for the petitioners as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent- State.

The contention of the petitioners is that the petitioners herein are arrayed as accused Nos.4, 8, 9 to 14 and there are no specific allegations against them and they are innocent of the said allegations. It is further submitted that, due to the political developments and local leadership rivalry, a false case is registered against them and accused No.1 was already arrested and released on bail. Therefore, he prayed the Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations against the petitioners are serious in nature and all these accused illegally trespassed into the house of the de-facto complainant and also tried to kill the de-facto complainant, therefore, they are not entitled for anticipatory bail and he also filed injury certificate of Avula Anjaiah (injured). Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, the petitioners herein are arrayed as accused Nos.4, 8, 9 to 14 and the specific allegation is against accused No.1 that he beat
Avula Anjaiah (injured) and there are no persons injured in the hands of the petitioners herein and the injury certificate of Avula Anjaiah (injured) shows that he sustained simple injuries. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioners/ accused Nos.4, 8, 9 to 14, subject to the following conditions: i.
The petitioners shall surrender before the Station House Officer, Alladurg Police Station, Medak District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/- each, with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of 8 weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
